Recently, the Trademark Office issued a decision on the registration of the trademark "Taishan" under No. 43927295.

The Trademark Office held that the opposed trademark "Taishan" provided by our company on behalf of the oppose did not constitute a similar trademark and the cited trademark provided by the opponent, and in accordance with Article 35 of the Trademark Law, the Trademark Office decided to register No. 43927295 "Taishan" commercial standard.

During the announcement period, the opponent cited the trademark "DawenkouTaishan" to file an opposition application against the opposed trademark "Taishan", and the opponent entrusted our company to make a defense to the Trademark Office. Our company conducted defense analysis from the aspects of meaning, shape and sound, and comprehensively compared the differences between the two trademarks.

In the end, the Trademark Office agreed with our defense and held that the opposed trademark "Taishan" was designated for use in Class 11 "ceiling lamp; Electric lamps" and other goods, the opponent cited the previously registered trademark No. 42050538 "DawenkouTaishan" and other trademarks approved for use in Class 11 "lamps; Electric heater" and other products. Although the goods designated for use by the opposed trademark and the goods approved for use by the opposition citation trademark are similar goods, there are certain differences in the word composition, call and overall appearance of the trademarks of the two parties, so the trademarks of the two parties do not constitute similar trademarks used on similar goods, and the registration and use of the opposed trademark should not cause confusion and misidentification among consumers. The opponent claimed that the opposed party violated the principle of good faith, maliciously copied and imitated its cited trademark, and that the registration and use of the opposed trademark was likely to cause adverse social impact.

Pursuant to Article 35 of the Trademark Law, the Trademark Office decided to register trademark "Taishan" No. 43927295.
