Entrusted by Anhui Gujing Distillery Co., Ltd.,ANDU filed an opposition to the trademark No. 60658474 "Long Chinese New Year's Eve" designated by Chongqing MenghuiGuzhen Food Co., Ltd. as a designator for Class 33 goods after preliminary examination by the Trademark Office, and requested the Trademark Office to reject the application for registration of the trademark, which was initially approved by the Trademark Office.

We consider that the goods designated for use in the opposed trademark " Long Nian San Shi" are "wines" of Class 33; liquor" and so on. The opposition cited the earlier registration of trademarks No. 39520099 and No. 49682702 "Long Nian San Shi", and the approved goods for use were Class 33 "liquor"; Fruit wine (alcohol)" is equivalent to one or similar goods. The opposed trademark completely contains the trademark "Chinese New Year's Eve" cited by the opponent, and the overall meaning of the trademarks of the two parties is not obvious, which is easy for the relevant public to mistakenly believe that the two are series trademarks from the same market entity or have a specific connection, thereby confusing and misidentifying the source of the goods, and the trademarks of the two parties have constituted similar trademarks used on the same or similar goods.

After examination and hearing, in accordance with Articles 30 and 35 of the Trademark Law, the CNIPA decided not to register the trademark No. 60658474 "Long Nian San Shi".
