1、Trademarks must submit an affidavit or they will be revoked
The Ministry of Commerce of Cambodia issued Announcement No. 2652 on August 11, 2023, which established strict requirements for trademark use/non-use oaths. The announcement states that the affidavit must be filed in the fifth year after registration to maintain the trademark's validity. Previously, the Intellectual Property Department was relatively lenient in enforcing this requirement, allowing owners to file an affidavit after the fifth year. This means that the right holder must submit the affidavit on time, otherwise the trademark will be revoked and there will be no opportunity to supplement the affidavit later.
2、Trademark applicants are required to apply for trademark applications in the form of one mark in multiple classes
The Cambodian Ministry of Commerce issued Announcement No. 2501 on August 1, 2023, requiring applicants to submit applications in multiple classes of trademarks in the form of one mark and multiple classes. Previously, applicants could choose to apply for multiple classes under one application. After the announcement is made, it means that applicants must apply in the form of one mark in multiple categories. This announcement is effective immediately upon being made. The purpose of this policy change is to reduce the administrative burden on the Intellectual Property Department in processing multiple applications for the same trademark.
Philippine
The Philippine Intellectual Property Office issued an announcement on August 14, 2023, stating that based on the "Terms and Regulations on Trademarks, Service Marks, Trade Names, and Marked Containers (2023)" that will take effect on February 14, 2023, it will no longer provide registration certificates including registration certificates.
